This policy (“Privacy Policy”) describes how Clubr collects, uses, and discloses information via our mobile application (“Application”) and website located at www.clubr.in, including third-party apps, sites and platforms (e.g., social media services) where our ticketing products and services are distributed (collectively the “Site”). Certain services, which you may access via the Application or on the Site, are provided by our third-party partners, and protection of your information relating to such services will be governed by the privacy policy of such third parties. By accessing, browsing and using the Application and/or Site, you acknowledge that you have read, understood and agreed to the Privacy Policy described herein.

This Privacy Policy details the manner in which Clubr (“Clubr/Us/Our/We”) collects, restores, deals and handles the end users’ (“You/Your/User”) information made available by the User as a result of such User’s access to and use services provided through Clubr Platform (which term shall be deemed to include the internet and mobile website www.Clubr.in as well as its mobile application).

The provisions of this Privacy Policy shall be deemed to be an integral part of and shall be read in conjunction with the T&C document (available here) and shall govern Your use of the services provided through Clubr Platform. This Privacy Policy has been published by Clubr to the applicable provisions of the Information Technology Act, 2000 as amended and the relevant rules made thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes under applicable Indian laws.

Your use of the Clubr Platform and the services provided there under shall be governed by this Privacy Policy as well as any other applicable policies published on this Clubr Platform, including but not limited to the Privacy Policy. Your use of the Clubr Platform whether for the purpose of transacting through Clubr Platform or otherwise, implies Your specific consent to the provisions of this Privacy Policy as well as other applicable policies. Clubr hereby reserves the right to modify, add or delete any part of this Privacy Policy without prior written notice/ intimation to You. It shall be Your sole responsibility to periodically review this Privacy Policy and all other applicable policies published on the Clubr Platform for any revisions thereto. If You do not agree to the revisions made to this Privacy Policy by Clubr, You must discontinue further access and use of the Clubr Platform and the services provided thereunder. You agree and acknowledge that such discontinuance of access to and use of the Clubr Platform and the services provided thereunder will render the Privacy Policy inapplicable from such date of discontinuance only; however this Privacy Policy will remain applicable to all instances of use by You of Clubr Platform and the services provided thereunder prior to such date of discontinuance by You.

It is clarified that terms and conditions specific to an event shall be published on the event page accessible on the Clubr Platform. In the event of any conflict between the event-related terms and conditions, and this Privacy Policy, User agrees that the terms of this Privacy Policy shall prevail and be binding on the User at all times.

By mere use of the Clubr Platform, You expressly consent to Our use and disclosure of Your personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the T&C.

Information We Collect

Information you provide

We collect Personal Data that you specifically and voluntarily provide to us while using the Site or Application. “Personal Data” refers to information that can identify you as a specific individual, such as your name, address, phone number, credit card number, or email address.

When you access or use the Site or Application, we automatically collect information about your visit, including:

• Log Information: We collect log information about your use of the Application and/or Site, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to our Site.

Information We Collect From Other Sources

For example, we may collect information about you from third parties, including but not limited to identity verification services, fraud detection service providers, credit bureaus, mailing list providers and publicly available sources. If you create or log into your account through a social media site, we will have access to certain information from that site, such as your name, account information and friend’s lists, in accordance with the authorization procedures determined by such social media site.

How We Use the Information We Collect

We use the Personal Data we collect primarily to provide you with the products and services you purchase or use from our Application and Site (either directly or through third parties), and to build features that will make the Application and Site easier to use. We also use the information we collect to: communicate with you, including to provide customer service; monitor and analyze trends, usage and activities in connection with our services; detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of Clubr; and to personalize the Site and Application, including by providing advertisements, content or features that match user profiles or interests.

Clubr Vendors and Providers

Many of the operations we perform require us to hire other companies to help us with these tasks. For example, Clubr may retain companies to help us handle marketing of our services, handle purchases of tickets to certain events, process credit card transactions, and provide customer service. The companies we retain to help us with these tasks have access to Personal Data to perform their functions, but may not use it for other purposes.

External Service Providers, Event Providers, and Clubr Users

When you use Clubr to purchase or sell tickets, we may provide Personal Data to the ticket seller, team, venue, promoters, league, or other third party involved in the sale of the ticket or otherwise related to the event. We may even ask you to transact directly with that third party vendor. For example, when you purchase a ticket, we may share your Personal Data (excluding payment information) with the seller of the ticket in order for the seller to complete the transaction. Similarly, when you purchase a ticket to an event (such as, but not limited to a concert), we may provide your Personal Data to the teams you see, the league or organization that sanctioned the concert promoter, and/or the operator of the venue or facility that hosted the event. Additionally, we may share information with third parties to assist in processing your payment with the seller, or a payment to you, if you are the seller. These third parties may use your Personal Data for analytics, offering you other products or services, preparation of reports, ticket fulfilment, as well as customer service and other legitimate business uses.

Third-Party Companies

We may enter into agreements with companies (including, for example, by way of a co-branded or private-labeled website) that offer their products or services on our Site or Application (“Third-Party Companies”), and you may be asked to transact directly with those Third-Party Companies relating to your purchase of tickets. As a result, we may disclose your Personal Data to the Third-Party Companies that co-brand their products and services on our Site or Application. Because we do not control the privacy practices of Third-Party Companies, you should read and understand their privacy policies.

Future Business Transfers

Our business is constantly changing. In the event Clubt goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your Personal Data will likely be among the assets transferred.

Compliance with Law and Protection of Clubr

Clubr reserves the right to disclose Personal Data in order to comply with the law. We may also disclose Personal Data to enforce or apply the terms and conditions applicable to our products and services, or protect the rights, property or safety of Clubr, our users, or others.

De-Identified Data

We may share aggregated or de-identified information, which cannot reasonably be used to identify you.

Advertising and Analytics Services Provided by Others

We may allow others to provide analytics services and serve advertisements on our behalf across the Internet and in applications. These entities may use cookies, web beacons, device identifiers and other technologies to collect information about your use of the Application or Site and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked, information about your location, and conversion information. This information may be used by Clubr and others to, among other things, analyze and track data, determine the popularity of certain content, and to deliver advertising and content targeted to your interests on our Site and Application and other websites and applications. Your device may also include a feature (“Limit Ad Tracking” on iOS or “Opt Out of Interest-Based Ads” on Android) that allows you to opt out of having certain information collected through applications used for interest-based advertising purposes.

Your Choices

How You Can Access or Change Your Personal Data

Clubr understands that you may want to change or access your Personal Data. To change your Personal Data, sign in and go to your “My account” page.

Email

If you would prefer not to receive notices of special savings or promotions from Clubr, you may simply opt-out from receiving them by accessing the “unsubscribe” link included within any email and/or contacting Clubr administrators at info@clubr.in. Please note that, even if you opt out of promotional emails, we may still send you service-related communications.

Tell a Friend

If you choose to use our referral service to tell a friend about our Application or Site, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Application or Site and may send follow up emails. Clubr stores this information for the purpose of sending this one-time email and tracking the success of our referral program

Cookies

You can always choose to not receive a cookie file by enabling a browser to refuse cookies or to prompt you before accepting a cookie. By refusing to accept cookies, you will not be able to take advantage of certain of the features and functions of our Site.

Location Information

You may be asked to consent to the Application’s collection of location information. If we collect your location information, you can subsequently stop the collection of this information at any time by changing the preferences on your mobile device. You may also stop our collection of location information by following the standard uninstall process to remove all of our mobile applications from your device.

Protecting Your Personal Data

As part of our efforts to prevent unauthorized access to Personal Data, maintain data accuracy, and ensure correct use of information, we will employ reasonable and current Internet security methods and technologies. However, no security system is impenetrable. We cannot guarantee the security of our servers, nor can we guarantee that your Personal Data will not be intercepted while being transmitted to us over the Internet.
